CHAPTER 12. COUNTY BOARDS OF EDUCATION
SUBCHAPTER 1. GENERAL PROVISIONS
A.C.A. § 6-12-101
§ 6-12-101 Creation -- Members generally.
(a) There is created for each county a county board of education composed of five (5) members, one (1) of whom shall be elected from each of five (5) zones within the county as provided in S> 6-12-104.
(b) The members of county boards of education shall be qualified electors known for their good moral character, honesty, industry, public spirit, and interest in education, and who do not hold any salaried or fee office of the state or any political subdivision thereof.
(c) One (1) member shall be elected at each annual election for a term of five (5) years, provided that any member of the board of education shall hold
office until his successor has been elected and qualified.
(d) A member may succeed himself.
(e) The county board of election commissioners shall notify each person elected, in accordance with the provisions of this chapter, as a member of the county board.
(f) Removal from the county or into another zone shall automatically disqualify the member from serving out the term for which he was elected.
(g) If a vacancy occurs on the board, the vacancy shall be filled by a vote of a majority of the remaining members. If the remaining members fail to fill a vacancy within sixty (60) days after the date of vacancy, the vacancy shall be filled by appointment by the county judge. If, as a result of several vacancies, only a minority of the board remains, then the county judge shall fill all the vacancies by appointment. Appointed members shall have the same qualifications as elected members but shall serve only to the next annual school election, at which time the electors shall select members to serve the unexpired terms of the vacating members.
(h) The members of the county board shall serve without compensation but shall be allowed actual expenses incurred in traveling to official meetings of the board and in the performance of the official business of the county board. The amount of one hundred dollars ($100), or so much thereof as is needed,
shall be allowed annually from the county general school fund for this purpose. If, in the judgment of the county judge and the unanimous opinion of the members of the county board, additional funds are necessary, an additional one hundred dollars ($100) may be allowed annually.

§ 6-12-102 Members -- Counties with fewer than five school districts.
(a) The county boards of education in counties having fewer than five (5) school districts may choose to be:
(1) Composed of one (1) member elected from each school district and one (1) member elected at large; or
(2) Organized in accordance with this chapter.
(b) In counties having only one (1) school district, the board of directors of that district shall act as the county board of education.
(c) The county boards of education may hire the staff they deem necessary and establish the salaries for that staff.

§ 6-12-103 Candidates.
(a) The county board of election commissioners shall place on the ballots used in each annual school election, as candidates for membership on the county board of education, the names of any qualified electors whose names have been presented to the county board of election commissioners by a petition signed by twenty (20) or more qualified electors of the zone such candidate seeks to represent, at least forty-five (45) days before the date of the election.
(b) Candidates must be residents of the zone wherein the vacancy exists or the term of the incumbent is expiring.
(c) The candidates for board member at large shall qualify in the same
manner, except that in such case the term "zone" shall mean the county as a whole.

§ 6-13-611 Vacancies generally.
(a) If a vacancy occurs on the school district board of directors, the vacancy shall be filled by a majority vote of the remaining directors.
(b) If, as a result of several vacancies on the board, only a minority of the directors remains, or if the remaining directors fail to fill vacancies within thirty (30) days, the vacancies shall be filled by appointment by the county board of education. (c) All appointed directors shall serve only to the next annual school election, at which time the electors shall select in the usual manner directors to serve the unexpired terms of the vacating directors.

§ 6-13-616 Qualifications of directors.
(a) Except as provided in subsection (c) of this section, no person shall be eligible to be a member of any school district board of directors in this state unless he is a qualified elector of the school district which he serves.
(b) No person who is elected to a school district board of directors shall be eligible for employment in that same school district.
(c)(1) A person whose residential property contains portions of two (2) school districts shall be eligible to be a member of either of the school districts' board of directors, provided he is a qualified elector of the county in which the school district for which he seeks the position lies and he has or
formerly had children enrolled in that school district.
(2) For purposes of this subsection, "residential property" means that parcel of land which contains the dwelling in which the person resides no fewer than nine (9) months out of each year.

§ 6-15-1007 Arkansas Leadership Academy.
(a) There is established the Arkansas Leadership Academy.
(b) The academy will provide a variety of training programs and opportunities to develop the knowledge base and leadership skills of school principals, as well as teachers, superintendents and other administrators, and school board members.
(c) The State Board of Education shall have the authority to issue requests for proposals if the board should determine to change the operator or the location of the academy.

§ 6-15-1202 Appointment of members.
The Director of the Division of General Education shall appoint the teacher representatives from a list submitted by the Arkansas Education Association; the administrator representatives from a list submitted by the Arkansas Association of Education Administrators; the school board members from a list submitted by the School Boards Association; the counselor from a list submitted by the Arkansas Counseling Association, the vocational teacher from a list submitted by the Arkansas Vocational Education Association; the parent representatives from a list submitted by the Arkansas Parent-Teacher Association; and the business representatives from a list submitted by the

§ 6-15-1302 Members.
(a) The Safe Schools Committee shall be composed of the following individuals:
(1) Two (2) classroom teachers appointed by the Arkansas Education Association;
(2) Two (2) school administrators appointed by the Arkansas Association of School Administrators;
(3) Two (2) school board members appointed by the Arkansas School Boards Association;
(4) A staff member of the State Department of Education, appointed by the
Director of the General Education Division;
(5) A school safety specialist employed by an Arkansas school district, appointed by the Director of the General Education Division;
(6) One (1) school counselor, appointed by the Arkansas Counseling Association; and
(7) One (1) additional person knowledgeable in the field of school safety, appointed by the Director of the General Education Division.
(b) The Chairmen of the House and Senate Education committees or their designees shall serve as ex-officio members of the committee.

§ 26-27-304 Selection of members.
(a)(1) Where the county equalization board consists of three (3) members:
(A) One (1) member shall be selected by the representatives of the several school districts of the county;
(B) One (1) member shall be selected by the members of the city and town councils of all cities and incorporated towns in the county; and
(C) One (1) member shall be appointed by the county judge.
The three (3) members shall be selected from different sections of the county.
(2) Where the board consists of five (5) members:
(A) Two (2) members, one (1) from each judicial district, shall be selected
by the representatives of the several school districts of the county;
(B) Two (2) members, one (1) in each judicial district, shall be selected by the members of the city and town councils of all cities and incorporated towns in the county; and
(C) One (1) member shall be appointed by the county judge.
(3) Where the board consists of nine (9) members:
(A) Three (3) members shall be selected by the representatives of the several school districts of the county;
(B) Three (3) members shall be selected by the members of the city and town councils of all cities and incorporated towns in the county; and
(C) Three (3) members shall be appointed by the county judge.
The selecting or appointing agency in each instance shall select or appoint the three (3) members from three (3) different sections of the county.
(b)(1)(A)(i) For the purpose of making the selection of their members of the county equalization board as provided in this section, the school board members of each school district in each county shall select one (1) representative and one (1) alternate representative for each school district.
(ii) The representatives of the several school districts of each county shall hold a meeting during the month of May of each year in which the term of any of their members of the board shall expire.
(B) The county judge shall serve as chairman of the meeting and shall issue the call therefor which shall specify the time, date, and place of the meeting.
(C)(i) The selection of members of the board shall be by majority vote of the school board representatives present and no action shall be taken unless there is a quorum present.
(ii) A majority of all of the school board representatives in the county shall constitute a quorum.
(2)(A) For the purpose of making the selection of their members of the board, the representatives of the city and town councils of the cities and incorporated towns in the county shall hold a meeting during the month of May of each year in which the term of any of their members of the board shall expire.
(B) The mayor of the county seat city or town or, if there are two (2) county seats, the mayor of the larger county seat city or town shall serve as chairman of the meeting and shall issue the call which shall specify the time, date, and place of the meeting.
(C)(i) The selection of members of the board shall be by majority vote of the representatives of the city and town councils present, and no action can be taken unless there is a quorum present.
(ii) A majority of all of the representatives of the city and town councils of all cities and incorporated towns in the county shall constitute a quorum.
(iii) Each of the cities and incorporated towns within the county shall be entitled to one (1) vote.
(iv)(a) The representative of each city or town shall be designated by resolution of the governing body of the city or town.
(b) Each city or incorporated town shall select one (1) representative and may designate alternate representatives, as may be required.
(3) The county judge of each county shall make his appointment of members of the board during the month of May of each year in which the term of any of his members of the board shall expire.
